Procedural Posture

Civil Appeal / Ruling on Withdrawal and Costs

  1. 1 Whether the 2nd Respondent should be awarded costs upon withdrawal of the appeal.

Ratio Decidendi

The court held that the general rule is that costs follow the event, and the withdrawal of the appeal amounts to a determination in favour of the Respondents. The 2nd Respondent had entered appearance and attended court, incurring legal costs. There was no consent to the withdrawal and no compelling reason to depart from the general rule. The court found it would be unjust to deny the 2nd Respondent costs in the circumstances and exercised its discretion to award costs on the usual party and party basis, to be taxed by the Deputy Registrar.

Court Disposition

Appeal withdrawn; costs awarded to the 2nd Respondent.

Orders

  • The appeal is marked as withdrawn.
  • Costs of the appeal awarded to the 2nd Respondent on party and party basis, to be taxed by the Deputy Registrar.
