Procedural Posture

Criminal Appeal / Judgment on Appeal

  1. 1 Whether the trial court shifted the burden of proof to the appellant.
  2. 2 Whether the prosecution proved the case against the appellant beyond reasonable doubt for obtaining registration by false pretences.

Ratio Decidendi

The court found that the prosecution had proved beyond reasonable doubt that the appellant willfully procured registration of land parcel Marama/Lunza/1282 in his name by falsely pretending that Emuhando Catholic Church had authorized the subdivision and transfer. The evidence established that the church officials did not participate in or consent to the transaction, the Land Control Board consent was not properly obtained, and the advocate who allegedly attested the transfer did not exist.
