The Plaintiff failed to establish a prima facie case with a probability of success because, at the time of the sale agreement, the 1st Defendant was no longer the registered proprietor of the suit property; the 2nd Defendant had already acquired title before the agreement. The 2nd Defendant was not a party to the sale agreement and thus not bound by its terms. There was no evidence that the 1st Defendant transferred the property to the 2nd Defendant after the sale agreement. Since the Plaintiff did not satisfy the first requirement for an interlocutory injunction, the court found it unnecessary to consider the other two requirements.
