Miscellaneous Application / Ruling on Applications for Substitution and Revival of Suit

  1. 1 Whether the court should enlarge time to allow substitution of deceased plaintiffs with administrators of their estates.
  2. 2 Whether the court should revive the suits of the deceased plaintiffs.
  3. 3 Whether the prior consent order allowing only surviving plaintiffs to proceed is binding and precludes the present applications.

Ratio Decidendi

The court found that a consent order had previously been entered into by the parties, allowing only the surviving plaintiffs to proceed with the matter and withdrawing the suit with respect to the deceased plaintiffs. This consent order had not been reviewed or set aside and, according to established legal principles, was binding on all parties. The court held that it could not entertain the applications for substitution and revival of the suits of the deceased plaintiffs in the absence of an application to set aside or review the consent order. As such, the applications for substitution and revival were struck out.

Orders
