The Defendant, despite being in possession, failed to secure recognition or registration from NSSF and admitted to not fulfilling the necessary requirements. The court held that the Defendant's continued occupation constituted trespass. The Plaintiff was entitled to exclusive possession, an injunction against the Defendant, and general damages for trespass calculated at Kshs. 100,000 per year for eight years. Costs and interest were also awarded to the Plaintiff.
