Ratio Decidendi

The Tribunal found that the 1st Petitioner retained capacity as Secretary General because his suspension was only proposed and not finalized by an Annual General Meeting, and thus he could institute the petition. The 2nd Respondent, as a registered sports organization, had capacity to defend the suit under the Sports Act. The Tribunal held that the evidence did not substantiate the allegations of conflict of interest, fraud, or improper conduct against the 1st Respondent sufficient to warrant removal as Chairperson. Similarly, the Executive Committee could not be removed solely for failure to hold meetings, as the KNPC Constitution provides that the committee remains in office...
