The court found that there was no direct evidence to support the applicant's claim that Kangundo/Kyevaluki/1175 and Kangundo/Mbusyani/583 were gifts to Anna Munyiva Kithimba. All relevant parcels were registered in the name of the deceased at the time of his death, and thus formed part of the estate. The Law of Succession Act, specifically Section 45, prohibits any intermeddling with the estate prior to confirmation of grant, rendering all purported sales of estate property before confirmation null and void.
