Ratio Decidendi

The Defendant had not filed a memorandum or record of appeal within the statutory period, and thus, under Rule 83 of the Court of Appeal Rules, the notice of appeal was deemed withdrawn. There was no valid appeal pending. The Plaintiff, as the successful party, was entitled to the release of the funds. The Plaintiff's former advocate was entitled to payment as per the certificate of taxation. The court exercised its discretion to allow the application and ordered the release and disbursement of the funds as specified, with the account to be closed thereafter.
