Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the respondent was negligent in failing to provide safe equipment for the appellant's work duties.
  2. 2 Whether the appellant proved his case on a balance of probabilities.
  3. 3 Whether the lower court erred in dismissing the appellant's claim for compensation.

Ratio Decidendi

The court found that the respondent, as employer, had a primary responsibility to ensure the safety of its employees and failed in this duty by requiring the appellant to use a defective tyre inflation pump, which had been reported as faulty and not repaired. The lower court erred in attributing fault to the appellant for using the equipment provided by his employer. The employer's failure to maintain safe equipment and to act on known defects amounted to negligence. The appellant proved his case on a balance of probabilities, and the dismissal by the lower court was unjustified. The court therefore set aside the lower court's order and awarded damages to the appellant.
