Ratio Decidendi

The court found that although the plaintiff had delayed for three months in setting down the suit for hearing after the close of pleadings, such delay was not inordinate given the circumstances of the judicial process in Kenya. The plaintiff had not provided a satisfactory explanation for the inactivity, but the court did not consider the delay sufficient to warrant dismissal of the suit for want of prosecution. However, the court found the plaintiff guilty of some delay and therefore awarded costs of the application to the defendants, assessed at KShs. 20,000, payable within 14 days, failing which the defendants could execute for the same.
