The court found that the plaintiffs had been in open, peaceful, and continuous occupation of 1.4 acres of the suit land for over 12 years, having entered the land pursuant to sale agreements in 1995 and 1997. The defendant failed to transfer the land despite full payment and did not take any steps to recover possession within the limitation period. The court held that the cause of action under contract would have expired by 1/12/2000, and the 12-year limitation period for adverse possession ran from that date. By 1/12/2012, the defendant's right to recover the land was extinguished under Section 7 of the Limitation of Actions Act. The plaintiffs had therefore acquired title to the 1.4...
