Ratio Decidendi

The Court held that the notice of appeal and record of appeal were filed out of time and without the requisite leave of the court, contrary to the mandatory provisions of the Court of Appeal Rules and Section 40 of the Succession Act. The respondent's failure to serve the letter bespeaking proceedings on the applicant disentitled him from relying on a certificate of delay. The Court rejected the respondent's reliance on Section 159 of the Constitution and the '02 principle', holding that these provisions do not excuse non-compliance with fundamental procedural requirements. The appeal was therefore incompetent and was struck out with costs to the applicant.
