Miscellaneous Criminal Application / Ruling on Application for Review of Sentence

  1. 1 Whether the High Court has jurisdiction to review a sentence imposed by a judge of concurrent jurisdiction.
  2. 2 Whether the period spent in custody prior to sentencing should be considered in reviewing the applicant's sentence.
  3. 3 Whether the Supreme Court decision in Muruatetu applies to the applicant's case.

Ratio Decidendi

The High Court lacks jurisdiction to review or revise a sentence imposed by a judge of concurrent jurisdiction, as doing so would amount to sitting in appeal over a peer's decision, which is prohibited by law. The applicant's sentence of thirty years imprisonment was not imposed under the mandatory death penalty provisions, and thus the Supreme Court's decision in Muruatetu does not apply. The proper forum for challenging the sentence is the Court of Appeal, not the High Court. Consequently, the application for review of sentence is without merit and must be dismissed for want of jurisdiction.
