Miscellaneous Application / Ruling on Application for Leave to Appeal Out of Time

  1. 1 Whether the applicant should be granted leave to file an appeal out of time from the decision of the Appeals Committee.
  2. 2 Whether the failure of the Appeals Committee to notify parties of its decision justifies extension of time for appeal.

Ratio Decidendi

The court found that there was no evidence that the Appeals Committee notified the parties of its decision, and the proceedings did not indicate that the decision was read in their presence. The absence of notification deprived the applicant of the opportunity to file an appeal within the statutory period. Although the Land Dispute Tribunal Act does not expressly provide for extension of time, the High Court's supervisory jurisdiction under the Constitution allows it to grant such relief to ensure justice is served. Granting leave to appeal out of time was necessary to address the procedural unfairness caused by the Tribunal's failure to notify the parties.

Court Disposition

Application allowed. Leave granted to file appeal out of time.

Orders

  • The applicant is granted leave to appeal within 30 days from today from the decision of the Appeals Committee at Embu Case No. 57 of 1999.
  • Each party shall bear their own costs.
