The Plaintiff lacked locus standi to institute the suit on behalf of the estate of Hannah Wanjiku Chege, as he had not obtained letters of administration and was not the legal representative of the estate. Even if he had capacity, the Plaintiff failed to prove on a standard higher than a balance of probabilities that the Defendant acquired the suit property fraudulently. The Defendant's title, registered in 2000, is protected under Section 26(1) of the Land Registration Act and can only be impeached on grounds of fraud or illegality, none of which were established by the Plaintiff. The Tribunal's award relied upon by the Plaintiff was quashed and declared null and void, and thus could not...
