The Court of Appeal held that the order of 23rd November 2009, which marked the respondent's application as withdrawn with no order as to costs, was made at the respondent's own request and in his favour. As such, it is not an order against which an appeal lies under the Civil Procedure Rules. Furthermore, the memorandum of appeal improperly sought to challenge the High Court's decision of 26th November 2007, from which no appeal was competent in the circumstances.
