Ratio Decidendi

The court found that the Defendant's husband purchased the suit land in 1977, took possession, and the Defendant has occupied it openly and continuously since then. By 1989, adverse possession had accrued, vesting title in the Defendant's husband, and subsequently in the Defendant. The Plaintiff's purported purchase from the deceased's sons in 2007 was void, as they lacked capacity to sell before obtaining letters of administration, and the transaction amounted to intermeddling under the Law of Succession Act. The Plaintiff's title, registered in 2014, was cancelled by court order in Judicial Review No 3 of 2015, and the Defendant's title was confirmed by judgment in ELC No 135 of 2015....
