The Plaintiff established, through unchallenged documentary evidence, that she is the registered proprietor of land parcel KERICHO/RORET/1090. The Defendants, having failed to enter appearance or file a defence, did not contest the Plaintiff's claim. The court found that the Plaintiff's title is protected under the Land Registration Act and the Constitution, and that the Defendants' occupation of the land without consent constitutes trespass. The Plaintiff is therefore entitled to protection of her proprietary rights, including a permanent injunction and an order for eviction of the Defendants from the suit property.
