Procedural Posture

Civil Appeal / Ruling on Jurisdiction

  1. 1 Whether the court has jurisdiction to hear an appeal where the Appeals Committee has not rendered a decision.
  2. 2 Whether an appeal can be properly filed in the absence of a final decision by the Appeals Committee.
  3. 3 Whether the matter is properly before the court in light of the Land Disputes Tribunals Act.

Ratio Decidendi

The court held that it lacked jurisdiction to entertain the appeal because the Embu Provincial Appeals Committee had not rendered a decision. Under Section 8 of the (now repealed) Land Disputes Tribunals Act, appeals to the court can only be made against decisions of the Appeals Committee. Since no such decision existed, there was no valid appeal before the court. The court emphasized that jurisdiction is fundamental and must be addressed immediately upon its emergence. Entertaining proceedings without jurisdiction would be a nullity, as established in binding precedent. Consequently, the matter was struck out and removed from the list of pending appeals.

Court Disposition

Appeal struck out for want of jurisdiction; matter disposed of.
