The Court of Appeal found that the trial judge's summing up to the assessors was wholly inadequate, depriving them of necessary guidance on the facts and law, and thus rendering the trial fatally defective. Additionally, the judge failed to properly consider the defences of the appellants and relied on a retracted confession without warning himself of the dangers of convicting on uncorroborated evidence of a co-accused. These serious procedural and substantive errors undermined the fairness of the trial and the safety of the convictions. Consequently, the convictions and sentences could not be sustained and were quashed.
