The purported lease and title issued to Bergei Agencies, from whom the plaintiff derived her title, were found to be irregular and invalid, as a valid lease already existed in favour of the 1st defendant. The court held that only one valid title can exist at any one time for a parcel of land, and a second title cannot be lawfully issued while the first subsists.
