The court found that the Plaintiffs' previous advocate misrepresented to them that the disappearance of the court file would result in the loss of their entire interest in the Suit Property, inducing them to accept a consent judgment that was to their detriment. The court held that the loss of a court file does not result in the loss of proprietary rights, as files can be reconstructed, and the advocate was aware of this. The misrepresentation was therefore fraudulent and induced the Plaintiffs to enter into the consent. The Plaintiffs' delay in seeking to set aside the consent was noted but did not outweigh the finding of fraud. Consequently, the consent judgment was set aside.
