Procedural Posture

Civil Appeal / Ruling on Notice to Show Cause for Dismissal of Appeal

  1. 1 Whether the Notice to Show Cause for dismissal of the appeal was properly issued under Order 17 Rule 2 of the Civil Procedure Rules.
  2. 2 Whether any step or application had been made in the appeal within one year prior to the issuance of the Notice to Show Cause.
  3. 3 Whether the appellant was properly notified of the need to fix the matter for directions.

Ratio Decidendi

The court found that the Notice to Show Cause was improperly issued because the appeal had been admitted on 10th April 2019 and the Notice was issued less than two months later, well before the lapse of the one-year period required under Order 17 Rule 2. There was no evidence that the parties had been served with the notice to fix the matter for directions, and the appellant had taken steps by filing the record of appeal. The court concluded that the procedural requirements for dismissal for want of prosecution had not been met, and the Notice to Show Cause was therefore vacated. Directions were issued for the expeditious hearing of the substantive appeal.

Court Disposition

Notice to Show Cause vacated; directions issued for expeditious hearing of appeal.

Orders

  • The Notice to Show Cause dated 4th June 2019 is vacated.
  • The appellant shall file and serve written submissions on the substantive appeal within seven days.
