Ratio Decidendi

The Industrial Court of Kenya lacks jurisdiction to hear and determine employment claims against the Nigerian High Commission due to the doctrine of diplomatic immunity, which can only be expressly waived by the Republic of Nigeria. The court found that diplomatic immunity is absolute in Kenya in the absence of legislation providing for restrictive immunity in employment matters. Furthermore, the claim was filed outside the three-year limitation period prescribed by section 90 of the Employment Act 2007, and the Act does not apply retroactively to employment disputes arising before its commencement. Consequently, the claim was dismissed both on grounds of lack of jurisdiction and limitation.
