Ratio Decidendi

The court found that although the evidence against the appellant was properly considered by the trial magistrate, the entire proceedings were rendered null and void because the prosecution was conducted by a police corporal not authorized by law to prosecute. This breach of section 85(2) of the Criminal Procedure Code invalidated the conviction and sentence. Additionally, the sentence of corporal punishment was illegal as such punishment had been abolished. Given that the appellant had already served over five years of his sentence, the court declined to order a retrial and ordered his immediate release unless otherwise lawfully held.
