Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the termination of the claimant's contract of service was unfair.
  2. 2 Whether the claimant is entitled to the reliefs sought.

Ratio Decidendi

The court found that while the respondent proved a valid and fair reason for termination—namely, the claimant's absence from work without permission—the respondent failed to follow the mandatory procedural requirements under section 41 of the Employment Act. The claimant was not given a show cause letter, nor was he invited to a disciplinary hearing to defend himself before dismissal. The court held that the failure to accord the claimant a fair hearing rendered the termination unfair within the meaning of section 45 of the Act. Consequently, the claimant was entitled to compensation for unfair termination and payment in lieu of notice, but not to service pay due to his NSSF membership.

Court Disposition

Judgment for the claimant for unfair termination.

Orders

  • The respondent shall pay the claimant Kshs.15,490 being one month salary in lieu of notice.
  • The respondent shall pay the claimant Kshs.123,920 being 8 months' salary as compensation for unfair termination.
