The court held that the PPDT lacked jurisdiction to entertain a dispute regarding the validity of nomination of a sitting Member of County Assembly after the nominee's name had been submitted to the IEBC, gazetted, and the individual sworn in. At that stage, any challenge to the validity of the nomination could only be brought before a court of law, specifically by way of an election petition before a magistrate's court, as provided by section 75(1A) of the Elections Act. The jurisdiction of the PPDT is confined to disputes arising from party primaries and internal party affairs prior to gazettement.
