  1. 1 Whether Mr Gachichio was properly instructed to represent the plaintiff company and withdraw the suit.
  2. 2 Whether the application to withdraw the suit was valid in light of existing status quo orders and representation issues.
  3. 3 Whether an advocate can act for both a defendant and subsequently for the plaintiff in the same matter without conflict of interest.

Court Disposition

Application to withdraw the suit expunged; matter to proceed to defence hearing.

Orders

  • The application dated January 22, 2022 seeking withdrawal of the suit is expunged from the record.
  • The plaintiff having closed its case, parties are directed to proceed for defence hearing.
