Procedural Posture

Civil Appeal / Application to Strike Out Record of Appeal

  1. 1 Whether the record of appeal was lodged out of time contrary to the Court of Appeal Rules.
  2. 2 Whether the appellant was entitled to the benefit of the proviso to Rule 81 of the Court of Appeal Rules regarding exclusion of time for preparation of proceedings.
  3. 3 Whether the certificate of delay was valid and reliable for purposes of computing time.

Ratio Decidendi

The Court found that the appellant was notified by the Deputy Registrar on 7th September, 2007 that uncertified copies of proceedings were ready for collection, and the time required for certification after that date was not excludable under Rule 81. The appellant failed to explain the delay between notification and payment for the proceedings, as well as the further delay before lodging the appeal. The Court held that the appeal was lodged out of time without leave, rendering it incompetent. The application to strike out the appeal was therefore allowed with costs.

Court Disposition
