The court found that the plaintiffs failed to effect proper service on the 2nd defendant, as there was no evidence of service of the plaint and chamber summons. The plaintiffs also failed to annex the required written authority for representative action, contrary to Order 4 Rule 1(3). Furthermore, the suit was filed in Embu, whereas the cause of action and the defendants' registered offices were in Nairobi, violating Section 15 of the Civil Procedure Act.
