Despite inconsistent documentation and failed or inconclusive age assessments, the prosecution did not resolve the anomaly. The court held that, in criminal proceedings, any inconsistency regarding the age of the accused must be resolved in favour of the accused. As such, the appellant was entitled to the protections of the Children Act, and, being of an age where criminal liability does not attach, the sentence imposed was unlawful.
