Civil Case / Ruling on Application for Review of Court Order

  1. 1 Whether the court should review or set aside its order dated 23rd November 2011 regarding the valuation and costs of developments on parcel land No. TULWET/LESSOS/BLOCK 3 (Nandet/34).
  2. 2 Whether there was an error apparent on the face of the record in the previous ruling.
  3. 3 Whether the Applicant's valuation report should be adopted in place of the previously accepted valuation.

Ratio Decidendi

The court found that there was no error apparent on the face of the record in its previous order dated 23rd November 2011 regarding the valuation and costs of developments on the disputed parcel of land. Both parties had presented valuation reports that were at opposite extremes, and the court had previously offered the opportunity for an independent valuation, which the parties declined. In the absence of new evidence or compelling reasons, the court determined that the Applicant had not demonstrated sufficient grounds to warrant a review or setting aside of the earlier order. The application was therefore dismissed for lack of merit, and each party was ordered to bear their own costs.
