The suit, filed on 15th October 2008, was outside the three-year limitation period for tort claims under section 4(2) of the Limitation of Actions Act. The Plaintiff did not bring herself within the exceptions provided by section 27, as the claim was not for personal injuries and no material facts were shown to have been outside her knowledge. Additionally, the Plaintiff failed to prosecute the suit for over two years after the defence was filed, and the reasons given for the delay were not satisfactory.
