  1. 1 Whether the petitioner has established grounds for dissolution of the marriage under the Marriage Act, 2014.
  2. 2 Whether the marriage between the petitioner and respondent has irretrievably broken down as defined by statute.

Ratio Decidendi

The court found that the petitioner and respondent had been separated for over ten years, with the respondent having deserted the matrimonial home for at least three years prior to the filing of the petition. The respondent did not oppose the petition. Under Section 65(6) of the Marriage Act, 2014, these facts constitute irretrievable breakdown and desertion, both valid grounds for dissolution of a Christian marriage. The court concluded that the marriage had irretrievably broken down and that there was no possibility of reconciliation. Accordingly, the court granted the order for dissolution of the marriage.
