The High Court lacks original jurisdiction to determine matters relating to child custody, maintenance, and access when the children court is already seized of the dispute. The Children Act vests such jurisdiction exclusively in the children court, with the High Court only having appellate jurisdiction, which was not invoked in this case. Furthermore, the High Court cannot direct the police on investigations, as the police service is constitutionally independent. Any application for review or variation of children court orders based on new evidence must be made before the children court itself.
