Ratio Decidendi

The court found that the injunctive orders issued by the trial court to protect MNM and the children had lapsed on 8th January 2023, as expressly stated in the appellate judgment delivered on 25th April 2024. There were no subsisting or enforceable court orders at the time of the alleged contempt by EMM. The present application, seeking committal for contempt and enforcement of alleged rights to the matrimonial home, was therefore improperly brought within the context of this appeal, rather than in a separate suit concerning matrimonial property. As such, there was no legal basis for granting the orders sought, and the application was dismissed as unmerited and filed in the wrong cause.
