Ratio Decidendi

The Court of Appeal found that the applicant had sufficiently demonstrated the existence of arguable grounds of appeal regarding the findings of the Environment and Land Court on the location of the land and adverse possession. The Court held that, while the grounds may or may not ultimately succeed, they were not frivolous. On the nugatory aspect, the Court noted that both parties claimed occupation, but the trial court had ordered the applicant to remove her structures from the respondent's land within 45 days, failing which removal would be at her cost. The Court reasoned that if a stay was not granted, the applicant could suffer irreparable prejudice if her structures were removed...
