The child had been under the care of the petitioner (father) since the separation, with no evidence of harm or risk, and the Children’s Officer’s report recommended maintaining the current arrangement to avoid disrupting the child’s education and way of life. Although the Children’s Court ordinarily has jurisdiction over custody matters, the High Court retains jurisdiction in divorce proceedings where custody is sought. The court therefore granted custody to the petitioner, with limited access to the respondent, and made no order as to maintenance since it was not sought.
