The Court of Appeal found that the applicant had satisfied the twin principles for the grant of a stay of execution or proceedings: there is an arguable appeal regarding the ownership and subdivision of the disputed land, and unless a stay is granted, the subject matter (land) may be altered, rendering the appeal nugatory. The court noted the contestation over the existence and ownership of LR NO. NAIROBI/BLOCK 121/245 and held that the interests of justice required preservation of the status quo pending the determination of the appeal. Accordingly, the court granted an order of stay in terms of the prayers sought in the Notice of Motion.
