Legal Issues
- 1 Whether the applicant is entitled to the release of motor vehicle Reg. No. KBQ 852W pending completion of investigations.
- 2 Whether conditions should be attached to the release of the motor vehicle.
Ratio Decidendi
The court allowed the application for release of the motor vehicle to the applicant because the respondent did not oppose the application and the applicant established ownership through the log book. However, since investigations were incomplete, the court imposed a condition prohibiting disposal of the vehicle without the investigating officer's permission to ensure the integrity of ongoing investigations.
Court Disposition
application allowed with conditions
Orders
- The subject motor vehicle Reg. No. KBQ 852W shall be released to the applicant.
- The applicant shall not dispose of the vehicle without the express permission of the Investigating Officer P.C Geoffrey Makori of Parklands Police Station until investigations are complete.

CRIMINAL DIVISION
MISC. CR. APPLICATION NO. 387 OF 2016

REPUBLIC………………………………………………..RESPONDENT
RULING
After hearing both parties on the application dated 21/10/2016, the same is allowed. The order is given more particularly because the respondent is not opposed to the application. Again, the subject motor vehicle Reg. No. KBQ 852W is registered to the Applicant as per the attached copy of the Log Book annexed to the Supporting Affidavit.
However, since the vehicle is still subject of incomplete investigations, I order that upon its release, the Applicant shall not dispose it without the express permission of the Investigating Officer P.C Geoffrey Makori of Parklands Police Station.
DATED and DELIVERED this 14th day of NOVEMBER, 2016.
