Ratio Decidendi

The statutes cited by the respondent as having been contravened (Subordinate Courts Separation and Maintenance Act, Cap 153 and Matrimonial Causes Act, Cap 152) were repealed in 2014 and thus inapplicable. The High Court retains jurisdiction to hear and determine matters regarding division of matrimonial property, which can only proceed upon proof of dissolution of marriage.
