Procedural Posture

Election Petitions / Judgment

  1. 1 Whether the applicant was denied a fair hearing before the dismissal of his complaint by the IEBC Dispute Resolution Committee.
  2. 2 Whether the applicant fulfilled all statutory requirements for nomination as an independent senatorial candidate.
  3. 3 Whether the applicant's complaint was filed within the prescribed time limits.

Ratio Decidendi

The court found that the applicant was not denied a fair hearing, as he had discussions with the respondent's returning officer and was given an opportunity to rectify anomalies in his nomination documents. The applicant failed to comply with the statutory requirements, including providing a soft copy of the list of supporters and properly drawn cheque, and did not submit the required documents within the prescribed time. Furthermore, the complaint was filed outside the 10-day period stipulated by Gazette Notice No. 2965 of 17.3.2017 and after the final list of candidates had been gazetted. The application was therefore lacking in merit and had been overtaken by events.
