The court found that the 1st Defendant was registered as proprietor of the suit land without a succession cause or grant of letters of administration, and that the deceased, having died in 1991, could not have transferred the land in 2012. The transfer was facilitated by the 2nd Defendant despite the absence of a confirmed grant, in contravention of the Law of Succession Act. The registration and issuance of title to the 1st Defendant were therefore irregular, illegal, and unprocedural.
