Procedural Posture

Criminal Appeal / Judgment

  1. 1 Whether the conviction of the appellant for incest was supported by credible and sufficient evidence.
  2. 2 Whether the sentence of life imprisonment was appropriate in the circumstances.

Ratio Decidendi

The court found that the evidence from the complainant, corroborated by her mother and the clinical officer, was credible and sufficient to prove that the appellant, her biological father, sexually assaulted her. The trial magistrate's finding on credibility was not to be disturbed absent clear error. The appellant's denial was unconvincing and unsupported by evidence. The conviction was therefore safe. However, the sentence of life imprisonment was deemed harsh and excessive for a first offender, and was substituted with a term of twenty years' imprisonment.

Court Disposition

Appeal dismissed on conviction; sentence varied.

Orders

  • The conviction of the appellant is upheld.
  • The sentence of life imprisonment is set aside and substituted with twenty (20) years imprisonment.
