Ratio Decidendi

The court found that the Respondent's uncontroverted testimony established that the marriage had irretrievably broken down due to lack of companionship, desertion, and public humiliation by the Petitioner. The court applied Section 66(6) of the Marriage Act 2014, which sets out the grounds for dissolution of marriage, and determined that the facts fell within several of those grounds. As the Petitioner withdrew his petition and did not contest the Respondent's allegations, the court accepted the Respondent's evidence and concluded that the marriage was beyond salvage. The court therefore allowed the Cross-Petition and ordered the dissolution of the marriage.
