Respondent

Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the claimant was unlawfully terminated from employment by the respondent.
  2. 2 Whether the claimant is entitled to salary arrears and pay in lieu of notice.
  3. 3 Whether the claim for salary arrears is statute barred under the Limitation of Actions Act and Employment Act, 2007.

Ratio Decidendi

The court found that the claimant was an employee entitled to the protections of the Employment Act, 2007. The respondent failed to notify the claimant of the allegations against him or provide an opportunity to be heard, violating statutory requirements for fair termination. The court determined that only salary arrears within the statutory limitation period were claimable, and awarded the claimant salary arrears for the period from 12 April 2009 to January 2010, as well as pay in lieu of notice based on his last drawn salary. The court declined to award maximum compensation, considering the nature of pastoral work, but found the termination was procedurally and substantively unfair.

Court Disposition

Claim partly allowed for salary arrears and pay in lieu of notice; costs to claimant.

Orders

  • The claimant is awarded Kshs 30,640 as pay in lieu of notice.
  • The claimant is awarded Kshs 273,534 as salary arrears.
