The court found that the trial magistrate's awards for general damages were inordinately low, even less than the amounts proposed by the respondents, and did not reflect the prevailing trends in comparable cases. The injuries sustained by the appellants were soft tissue injuries, and while the cases cited by the appellants were outliers, the awards in the authorities cited by the respondents were more comparable. Taking into account inflation and the passage of time since those decisions, the court held that the awards should be increased to fairly compensate the appellants.
