The respondent could not unilaterally introduce or vary the qualification requirement after employment without consulting and notifying the claimant in writing as required by law. The termination was therefore invalid and unfair under sections 41 and 43 of the Employment Act, 2007, as the claimant was not given notice or a hearing.
