Although the applicant participated in the taxation process in the subordinate court, the existence and validity of the arbitration clause was not disputed by either party. The court held that once the trial magistrate acknowledged the arbitration clause, he ought to have stayed the proceedings and referred the matter to arbitration, as required by Section 6(1) of the Arbitration Act.
