  2. 2 Whether the attachment made by auctioneers should be lifted and discharged.
  3. 3 Whether the conditions for granting stay under Order 42 Rule 6 of the Civil Procedure Rules have been met.

Ratio Decidendi

The court found that the applicant demonstrated an arguable appeal and that failure to grant a stay would render the appeal nugatory. The court was satisfied that the application was made without undue delay and that the applicant would suffer substantial loss if the stay was not granted. The court exercised its discretion to grant a conditional stay, ordering the applicant to release the sum of Kshs. 264,034 held in the judgment debtor's account to the respondent within 30 days, and stayed further execution pending the determination of the appeal. Costs were reserved to await the outcome of the appeal.
